WayKargo is a technology marketplace that connects customers ("Clients") seeking transportation services with independent drivers ("Drivers"). WayKargo does not provide transportation services, own vehicles, employ drivers, or act as a carrier, freight forwarder, or logistics company.
By using the WayKargo website, mobile applications, or related services, you agree to these Terms and Conditions.
2. Nature of the Service
WayKargo operates solely as a digital platform that facilitates connections between Clients and Drivers.
- WayKargo does not transport goods.
- WayKargo does not own or operate vehicles.
- WayKargo does not employ drivers.
- WayKargo does not supervise deliveries.
- WayKargo does not take possession of cargo.
- WayKargo does not guarantee delivery times or outcomes.
- Drivers are independent contractors and are solely responsible for the transportation services they provide.
3. Driver Responsibilities
Drivers agree that they are solely and fully responsible for the transportation services they provide through the platform.
Cargo Inspection
Before accepting or transporting goods, Drivers must inspect cargo and ensure that:
- The goods match the Client's description.
- The cargo is safe to transport.
- The goods are lawful and permitted.
Illegal Goods
Drivers must not transport:
- Illegal drugs or narcotics.
- Weapons prohibited by law.
- Stolen goods.
- Counterfeit goods.
- Hazardous materials without proper permits.
- Any goods prohibited under applicable laws.
- Drivers bear full responsibility for transporting illegal or prohibited goods.
Damages and Losses
Drivers are fully responsible for:
- Damage to cargo.
- Loss of cargo.
- Theft during transportation.
- Vehicle accidents.
- Personal injuries.
- Traffic fines and violations.
- Insurance coverage.
- Claims arising during transportation.
- WayKargo bears no responsibility for any of these events.
4. Client Responsibilities
Clients are solely responsible for:
- Providing accurate cargo descriptions.
- Declaring the correct weight and dimensions.
- Packaging goods appropriately.
- Ensuring goods are legal to transport.
- Providing accurate pickup and delivery addresses.
- Clients agree not to ship illegal substances, dangerous or prohibited materials, stolen goods, counterfeit products, explosives, or unlawful items.
- Clients assume full legal responsibility for the contents of their shipments.
5. Limitation of Liability
To the maximum extent permitted by law, WayKargo shall not be liable for:
- Theft of cargo.
- Loss of cargo.
- Damage to goods.
- Vehicle accidents.
- Personal injuries.
- Delays in pickup or delivery.
- Illegal cargo.
- Traffic violations.
- Driver misconduct.
- Disputes between Clients and Drivers.
- Loss of profits or business interruption.
- Any dispute regarding transportation services shall be resolved directly between the Client and the Driver.
6. Independent Contractors
Drivers using WayKargo are independent contractors.
Nothing in these Terms creates employment, agency, partnership, or joint venture.
- Drivers are solely responsible for taxes.
- Drivers are solely responsible for insurance.
- Drivers are solely responsible for vehicle maintenance.
- Drivers are solely responsible for business licenses.
- Drivers are solely responsible for compliance with transportation laws.
7. Insurance
WayKargo does not provide cargo insurance or transportation insurance unless expressly stated.
Clients are encouraged to insure valuable cargo separately.
Drivers are responsible for maintaining all legally required insurance.
8. User Accounts
Users are responsible for maintaining account security, protecting login credentials, and reporting unauthorized access immediately.
- WayKargo may suspend or terminate accounts involved in fraud.
- WayKargo may suspend or terminate accounts involved in illegal activities.
- WayKargo may suspend or terminate accounts using false information.
- WayKargo may suspend or terminate accounts involved in abuse of the platform.
- WayKargo may suspend or terminate accounts with repeated policy violations.
9. Governing Law
These Terms shall be governed by the laws of the Republic of Ghana.
Any disputes shall be subject to the jurisdiction of the courts of Ghana.
